The Greater Springfield Chamber of Commerce opposes the Employee Free Choice Act (EFCA). EFCA, also called Card Check, would negatively impact the rights of both employees and employers and would harm economic recovery and growth in the United States.
EFCA would effectively eliminate the secret ballot election for union organizing and force workers to make the important decision about whether or not to unionize in front of union organizers. It would invite intimidation and coercion; exclude the interest of workers who may oppose unionization by cutting them out of the process; and limit an employer's ability to counter false and misleading rhetoric.
EFCA radically alters collective bargaining by limiting good faith negotiations to 120 days after which it forces employers into binding interest arbitration to set all the terms and conditions of a union contract - not just wages and benefits, but work rules, management rights clauses, and how union dues are collected.
EFCA imposes new penalties only on employer misconduct, not on union misconduct.
While some believe that businesses in right-to-work states would not be affected by EFCA, workers in these states are likely to find themselves unionized as the result of a secret card check campaign. Workers in right-to-work states have the right to refuse to pay union dues, but if the workplace is organized, they must give up their right to deal directly with their employer. Likewise, employers would be forced to accept arbitration agreements that may impose conditions inconsistent with established business models and impede the ability for a business to compete.
It is critical that businesses have the flexibility necessary to meet the needs of a challenging economy.
